Campaign rules: Stamps and Coupons

1. Scope of these Rules and the organiser
1.1. These Rules set out the conditions on which the Seller gives Stamps, issues Coupons and runs Campaigns for the Users of the App. They are the document to which the Terms of use of the App (the "Terms") refer, and they form an integral part of the Terms.
1.2. The organiser of every Campaign is the Seller: SRL "DII-TEH-GROUP", IDNO 1017600052819, seat at mun. Chișinău, str. Socoleni 2/6, Republic of Moldova, telephone [SUPPORT TELEPHONE], e-mail dev@e-gaz.md. The Seller must show the same details in the App.
1.3. A term written with a capital letter and not defined in chapter 2 has the meaning given to it in the Terms.
1.4. A Stamp and a Coupon are not money, are not electronic money and create no money claim against the Seller. They cannot be sold or exchanged for cash.
1.5. Campaigns carry no element of chance. A Stamp is given for a payment made by the User, and a Coupon is issued when the User reaches the Threshold published before the Campaign starts. The Seller runs no draws and gives no prizes by lot.
1.6. If a provision of the Terms and a provision of these Rules contradict each other on Stamps, Coupons and Campaigns, these Rules apply. These Rules may not, however, cut down a right that the Terms or the law give the User; in that case the provision more favourable to the User applies.
2. Definitions
2.1. Campaign: the promotional offer under which the Seller gives Stamps and issues Coupons, for an announced period and on the conditions published in the App.
2.2. Stamp: the mark the Seller gives the User for a payment that meets the conditions of a Campaign.
2.3. Coupon: the User's right to the free product or to the discount written on it.
2.4. Threshold: the number of Stamps, or the amount of payments, that gives the right to a Coupon.
2.5. Progress: the number of Stamps the User has collected in a Campaign, or the amount of the User's payments built up in that Campaign.
2.6. Activity window: the period announced by a Campaign for keeping the Progress.
2.7. Service line: one of the four kinds of activity of the Network, under the marks eGaz (fuel), eWash (wash), eDrive and eMarket.
3. Participation
3.1. A User may take part if he has reached 18 (eighteen) years of age and holds an active User account. Participation is free of charge and needs no separate application.
3.2. A User has one User account, and therefore one Progress in each Campaign.
3.3. A Company user takes part as a User, for payments from the ePay card.
3.4. The User may stop taking part in Campaigns at any time, from the App or through support, without closing the User account and at no cost. Coupons already issued stay valid until the date written on them, and the Progress is cancelled. The User may come back to the Campaigns at any time, with the Progress starting from zero.
3.5. Participation also ends when the User account is closed, under clause 12.1.
4. Campaigns
4.1. The Seller may run three kinds of Campaign: a) by the number of payments, where each payment that meets the conditions of the Campaign gives one Stamp, and on reaching the Threshold the User receives a Coupon; b) by the amount of payments, where the amounts of the payments that meet the conditions of the Campaign are added up, and on reaching the Threshold the User receives a Coupon; c) by direct issue, where the Seller issues Coupons to a group of Users set by an objective criterion which is announced in the App before the issue, for example all active Users of one Service line.
4.2. Each Campaign has its own page in the App. Before the Campaign starts, that page must show: a) the name of the Campaign and its organiser; b) the kind of Campaign; c) the Service lines and the Sites where Stamps are given; d) the start date and the end date; e) the Threshold; f) the minimum amount of a payment that gives a Stamp; g) the maximum number of Stamps per day; h) the Activity window, where the Campaign sets one; i) the reward; j) the Service line and the Sites where the Coupon is redeemed; k) the period for which the Coupon is valid. This information is published under Law No. 284 of 22.07.2004 on information society services, art. 22(2)(c).
4.3. The conditions of a running Campaign stay unchanged. If the Seller wants other conditions, it ends the Campaign under clause 11.4 and launches a new one.
4.4. One payment gives at most one Stamp in one Campaign. The same payment may give one Stamp in each Campaign running on its Service line.
4.5. A Balance top-up gives no Stamps and does not count towards the Threshold of a Campaign.
4.6. The Seller may suspend a Campaign because of a technical fault or to check a suspicion of abuse. A suspension may not last longer than [10] (ten) days. During it no Stamps are given and the Progress collected is kept; the end date of the Campaign and the Activity window are extended by the length of the suspension. The suspension and its reason must be shown on the page of the Campaign. Where a suspension would run beyond [10] (ten) days, the Campaign ends under clauses 11.4 and 11.5.
5. Stamps
5.1. A Stamp is given for a payment from the ePay card, after the service has been provided: at eWash Sites, after the wash post starts; at eGaz Sites, after the Fiscal receipt of the fuelling is issued. In this version Stamps are given only at eGaz and eWash Sites, because only there is payment made from the Balance.
5.2. Payments from a Company card give no Stamps. The same rule applies to a payment made from the User part held on a Company card.
5.3. No Stamp is given for a payment below the minimum amount of the Campaign.
5.4. Unless a Campaign provides otherwise, the User receives at most [2] (two) Stamps per day. The calendar day is counted by the official time of the Republic of Moldova. Payments above that number give no Stamps.
5.5. The User sees the Progress in the App, for example "5 of 8". On reaching the Threshold the Coupon is issued at once and the Progress starts from zero. In a Campaign by the amount of payments, the part above the Threshold moves into the Progress of the next Coupon of the same Campaign: at a Threshold of 1,000.00 lei, a User who has built up 1,050.00 lei receives the Coupon, and 50.00 lei stay in the next Progress.
5.6. Where a Campaign sets an Activity window, the Progress is cancelled if the User makes no payment giving a Stamp within the announced period. The Seller must warn the User 5 (five) days before the cancellation, in the App and by SMS.
5.7. A Refund of a payment cancels the Stamp given for that payment; in a Campaign by the amount of payments, the refunded amount is taken off the Progress, and the Progress does not fall below zero. If the cancelled Stamp led to the issue of a Coupon that has not been redeemed, the Seller withdraws the Coupon and tells the User in the App. A Coupon already redeemed is not withdrawn.
5.8. Every movement of Stamps is recorded in order of time, and no record is altered afterwards. A Correction is always a new record. On request, the Seller must give the User the list of the User's movements in a Campaign within [5] (five) working days, free of charge, on a durable medium.
6. Coupons
6.1. Under a Coupon the User receives the product or the discount written on it, for example a large coffee free of charge or a discount on a wash. The Coupon shows the Service line and the Sites where it is redeemed, and the period for which it is valid.
6.2. A Coupon is personal. It cannot be sold, passed to another person or exchanged for money, and no change is given for it.
6.3. In the App, in the section "My coupons", the Coupon is shown with a Rotating QR, which changes about every 30 (thirty) seconds. A short string of digits is shown under the Rotating QR and changes in the same way. The string of digits is used when the till scanner does not work.
6.4. A Coupon may be redeemed once only. The cashier scans the Rotating QR or keys in the string of digits, checks the Coupon in the Seller's system and gives the discount or hands over the product at the till. The system keeps the date, the time and the Site of the redemption.
6.5. At eDrive and at eMarket the Coupon is redeemed in the same way: the cashier checks it in the Seller's system and gives the discount at the till of the Site. Payment from the Balance is not accepted at eDrive or at eMarket.
6.6. A Coupon is redeemed at the Sites of the Service line written on it. At a Site of another Service line it is refused, and the cashier must tell the User where the Coupon is valid.
6.7. Redemption needs a connection to the Seller's system. If the Site has no connection at that moment, the Coupon stays valid and the User may redeem it until the date of expiry; where that date is near, clause 6.13 applies.
6.8. The period of validity is written on the Coupon. Unless a Campaign provides otherwise, that period is [30] (thirty) days from issue. The Seller must send the User a notice in the App 3 (three) days before expiry.
6.9. An expired Coupon is cancelled. The Seller does not extend it and does not replace it, and the User receives no compensation for it, apart from the cases in clause 6.13.
6.10. The conditions of a Coupon are those of the day it was issued. A later change of the Campaign does not alter them.
6.11. A Coupon is added to the ePay discount: the Coupon applies to the price already reduced by the ePay discount. With other discounts a Coupon is not added, unless the Campaign provides otherwise. Before the payment is confirmed, the App must show the final price.
6.12. If the product written on the Coupon is not available at the Site, the Coupon is not redeemed and stays valid. With the User's agreement, the cashier may hand over an equivalent product.
6.13. The Seller must issue a new Coupon, of the same content and valid for [7] (seven) days from issue, in the following cases: a) the Coupon was recorded as redeemed and the product or the discount was not given; b) the product written on the Coupon was not available at the Site and fewer than [7] (seven) days were left until expiry; c) redemption was impossible for want of a connection to the Seller's system, in the last 3 (three) days of the period. The User reports the facts under chapter 9, and the Seller checks them in its own records.
6.14. The same rules apply to a Coupon issued directly under clause 4.1(c).
7. Abuse
7.1. The following are abuse, where the User acts intentionally or takes part in the act: a) creating several User accounts, or using another person's telephone number, in order to collect Stamps; b) recording payments that did not happen, alone or with the help of an employee of the Seller; c) splitting one payment artificially into several payments in order to obtain extra Stamps; d) making payments followed by repeated Refunds in order to obtain Coupons; e) using a Coupon belonging to another person, or passing one's own Coupon to another person; f) obtaining Stamps or Coupons knowingly, by exploiting an error of the App or of the equipment of a Site.
7.2. If the Seller establishes an abuse, it must choose the lightest sufficient measure and must show the User the facts it relies on: a) it cancels the Stamps and the Coupons obtained by the act established, and leaves untouched the Stamps and Coupons unconnected with it; b) it stops the User's participation in Campaigns for a period of at most [90] (ninety) days; c) it suspends the User account or terminates the contract, under clauses 15.2 and 13.7 of the Terms. The User's Balance is not cancelled and is paid back under chapter 13 of the Terms.
7.3. A Stamp or a Coupon received through an error of the Seller, without an act of the User, is corrected by a new record and by nothing else.
7.4. The Seller must tell the User in the App about the measure taken, about the act that led to it and about the User's right to contest it.
7.5. The User contests the measure by the routes set out in chapter 9. If the objection is well founded, the Seller must restore the cancelled Stamps and Coupons. A Coupon whose period expired in the meantime is replaced by a new one of the same content.
8. Tax position
8.1. A Coupon is a price discount or a free product within a promotional Campaign. The discount or the free product is shown on the Fiscal receipt issued by the till of the Site.
8.2. The Seller must perform its own tax duties connected with Campaigns. The User pays the Seller nothing for a Stamp or for a Coupon.
9. Complaints
9.1. A complaint may concern a Stamp, a Coupon, a Progress or any measure taken by the Seller under these Rules. The User makes it in the App, by e-mail to dev@e-gaz.md or in writing at the seat of the Seller, mun. Chișinău, str. Socoleni 2/6.
9.2. The Seller must register the complaint, must confirm that it has been received and must answer within 14 (fourteen) calendar days of receipt, under art. 9(j) and art. 10(j) of Law No. 105 of 13.03.2003 on consumer protection. A refusal must be given in writing, with its reasons. No answer within the period counts as a refusal.
9.3. The Seller must check the complaint in its own records. The User may state the date of the payment, the Site and the amount, to speed the check up, but the complaint is examined without those details as well.
9.4. The User may apply to the State Inspectorate for the Surveillance of Non-Food Products and Consumer Protection, page https://consumator.gov.md, telephone [ISSPNPC TELEPHONE], or to a court. Making a complaint to the Seller does not limit that right.
10. Personal data
10.1. The Seller processes the data needed for Campaigns: the payments that give Stamps, the Progress, the Coupons issued and their redemption. The purposes, the legal grounds, the retention periods and the User's rights are set out in the Privacy policy.
10.2. Advertising messages about new Campaigns are sent only to a User who has given his consent to such messages, under Law No. 284/2004, art. 22(1). The consent may be withdrawn at any time in the App.
11. Changes to these Rules and the end of a Campaign
11.1. The Seller may change these Rules only for one of the reasons set out in clause 20.1 of the Terms: a) a change of the law or a new requirement of an authority; b) a change of a supplier or of the payment channel; c) the addition or the withdrawal of a Site, of a Service line or of a function of the App; d) the security of Users and of the systems; e) the correction of an error or of an unclear wording.
11.2. The Seller must announce the change under clause 20.2 of the Terms, in the App and by SMS or by e-mail, at least [15] (fifteen) days before the date from which it starts to apply. The announcement states that date and the list of the changes.
11.3. A change does not apply to Campaigns already started, nor to Stamps and Coupons obtained before its date.
11.4. The Seller may end a Campaign before the announced date only for one of the reasons in clause 11.1 and only on the notice set out in clause 11.2. The announcement states the reason and the date of the end.
11.5. Stamps collected until the end date stated in the announcement stay valid until that date. Until then the User may reach the Threshold and receive the Coupon.
11.6. Coupons already issued stay valid until the date written on them, even if the Campaign has ended or these Rules have changed in the meantime.
11.7. A User who does not accept a change may stop taking part under clause 3.4, or may ask for the User account to be closed under clause 13.1 of the Terms. Neither route costs anything and neither carries any other consequence for the User.
11.8. Each version of these Rules carries its number and its date. Earlier versions must be sent on request within [5] (five) working days, free of charge, on a durable medium.
12. Closure of the User account
12.1. Until the User account is closed, the User may redeem the Coupons already issued. On closure, the Stamps and the Coupons that have not been redeemed are cancelled.
12.2. The cancellation gives no right to a payment or to any other compensation, because a Stamp and a Coupon are not exchanged for money and create no money claim. The Balance is paid back under chapter 13 of the Terms.
12.3. Where the closure follows a change the User did not accept, or the exercise of the right of withdrawal from the contract, it costs nothing and leaves the Coupons untouched: the User may redeem them until the date of closure, and the Seller does not ask the User to give up any right.
13. Final clauses
13.1. These Rules are governed by the law of the Republic of Moldova.
13.2. Disputes are settled under chapter 21 of the Terms: first by talks, then by the courts of the Republic of Moldova. Out-of-court settlement follows clause 14.7 of the Terms. A User who is a consumer may sue at the court of the User's own domicile.
13.3. No provision of these Rules limits the rights that the law gives to a User who is a consumer, among them the Civil Code of the Republic of Moldova No. 1107 of 06.06.2002 and Law No. 105/2003.
